…In this article, we are concerned with the second way—you are hiring an employee-independent contractor-intern to add something to your work of art and you want to retain complete ownership of the copyright. Have them sign a contract, which includes a clause stating, s/he relinquishes all copyright which remains with [your name or your company's name].

Reasons why you might want to find someone to help you in your studio; deciding on the needed qualifications; basic requirements; tax and payroll implications of the employee, independent contractor, or the intern (includes an IRS checklist); which is best suited to your needs; who needs to supply Workers Compensation or Unemployment insurances and what to watch out for; how to protect yourself in a work-for-hire situation; protecting yourself from lawsuits during an interview and through the hiring or firing process; when you must pay attention to anti-discrimination statutes; why you need to keep excellent records; federal and state regulations that must be posted for the benefit of your employees; agencies which provide background information on potential employees and what to beware of; your responsibilities in withholding payroll and other taxes; and, the forms which you must file at the end of the year.

Kathy Davie is an artist, educator, and author of the arts marketing series, Your Portfolio & You, aimed at helping artists survive (and thrive) at the business of being an artist.

As a self-taught artist, Kathy was frustrated by the lack of information on taking her career to a more professional level while meeting legal guidelines and learning about legal hiccups. Her drive for information fueled her to interview numerous professionals and compiled the information into a monthly news column. She now leads workshops and is converting the news columns into this continuing series of how-to books.

Kathy has a BS in Technical Writing & Editing with minors in Digital Media and History from Metropolitan State College, Denver, CO and is the author of Accounting for the SMALL Businessperson, How Copyright Applies to the Artist, the Buyer, the Employer/e, the Sold Artwork, Dealing with Photographs, Slides, Digital Images, and Surviving the Outdoor Arts Festival.
